Do I always need probate if someone passed away?
Not always! Depending on how property is titled and the size of the estate, there may be simpler alternatives like a small estate affidavit. Part of what we do is help you determine the right path. We do recommend that you create an estate plan beforehand in order to protect your family and assets.
What’s the difference between a will and a trust?
Both help plan for the future, but they serve different purposes. A will outlines your wishes after death and often requires probate depending on the assets involved, while a trust can help avoid probate altogether. We’ll help you decide what makes the most sense for your situation.
How much will this cost?
That depends on your needs. We offer a free consultation to understand your situation and give you a clear idea of the next steps and associated costs, no surprises.
Do I need an estate plan even if I don’t have a lot of assets?
Absolutely. Estate planning isn’t just for the wealthy. It’s for anyone who wants to make things easier for their loved ones and ensure their wishes are respected.
Can I get a bank account transferred out of my loved one's name after they pass?
It depends on how the account was set up or on the balance remaining in the account after your loved one’s death. If there was a named beneficiary or a payable-on-death designation, the bank should be able to transfer it directly. If not, you might need a small estate affidavit or even a probate, depending on the account value and other circumstances. We can help you figure out the right steps based on your specific situation!
Can I just download a form online for this?
